Dup Terms of Service

These Terms of Service (the “Terms”) govern your download, installation, purchase, and use of Dup, the related Stratoxphere account and licensing services, and any updates or documentation we provide (collectively, the “Service”).
The Service is provided under the Stratoxphere Lab name (“Stratoxphere,” “we,” “us,” or “our”). You can contact us at [email protected]. The operator’s legal identity is disclosed in the Contact section below.
By creating or connecting an account, purchasing Dup, or using the Service, you agree to these Terms and the Dup Refund Policy, and you acknowledge the Dup Privacy Policy. Any additional commercial terms displayed before purchase also form part of your agreement. If you use Dup on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
1. Eligibility
You must be legally capable of entering into these Terms and permitted to use the Service under applicable law. Dup relies on third-party services that may impose their own eligibility, account, regional, and permitted-use requirements. You are responsible for satisfying the current requirements of any third-party service you choose to use with Dup.
2. What Dup Does
Dup is a desktop dictation and text-modification application. The Dup Privacy Policy explains what data Dup processes on your device and sends to third-party services.
The Service also includes Stratoxphere-hosted account, commerce, access, device, and licensing functions. Those functions do not provide the AI processing itself.
3. Your Account
You must provide accurate information and keep your account secure. You are responsible for activity performed through your account and for maintaining control of devices connected to it. You may not sell, transfer, rent, or share your account or access credentials.
Contact us promptly at [email protected] if you believe your account or a connected device has been compromised. We may require you to reconnect Dup or verify your identity to protect the Service.
4. Purchases and Creem
Available purchase options, price, currency, applicable taxes, license scope, and any offer-specific conditions are shown before you complete checkout. Terms for an offer or promotion apply only when expressly presented to you and may be subject to separate eligibility and redemption conditions.
Creem acts as the merchant of record and contractual reseller for the transaction. Creem processes payment, issues the invoice, handles applicable indirect taxes, and provides its Customer Portal. By purchasing Dup, you also agree to the current Creem Buyer Terms. If these Terms conflict with Creem’s terms on a matter Creem controls as merchant of record, Creem’s terms control that matter.
Stratoxphere determines refund eligibility under the Dup Refund Policy and applicable law. Creem exclusively processes approved refunds, reversals, and chargebacks through its payment systems and may also issue a refund where permitted by its terms or required by law. A refunded, reversed, or disputed purchase ends the related Dup license and access.
5. License
After a valid purchase is confirmed and an active license is issued, Stratoxphere grants you a limited, worldwide, non-exclusive, non-transferable, non-sublicensable license to install and use the then-supported version of Dup within the license scope presented at purchase, for your own lawful internal purposes, subject to these Terms.
The license permits use of Dup; it does not transfer ownership of Dup, its source code, branding, or other intellectual property. A purchase does not promise a particular duration of third-party services, compatibility with every future operating system, future products, or any particular future update.
Dup may connect to the Stratoxphere Platform to activate devices and periodically confirm that access remains valid. The Service may refuse or revoke access where the license is invalid, refunded, disputed, transferred without permission, exceeds its activation allowance, or is used to circumvent access controls. You can manage supported device activations through your Stratoxphere account.
Only the latest released version of Dup is supported. We may require an update where reasonably necessary for security, compatibility, licensing, legal compliance, or reliable operation.
6. Your API Keys and Inference Providers
An inference provider is a third-party service you select for transcription or language-model processing in Dup. You obtain and control your own API keys for your selected inference providers. You are responsible for their security, activity, usage charges, configuration, and lawful use. Before using a provider’s features, review and comply with the current terms and privacy policies published by that provider for the services you use.
Those documents may change independently of these Terms and govern the corresponding provider’s services. The Dup Privacy Policy explains which content is sent to each selected provider.
Stratoxphere does not restate or modify those providers’ requirements and cannot make an otherwise prohibited use permissible. Inference providers and other third-party services may change, become unavailable, reject a request, or produce an error. Those services are not controlled by Stratoxphere.
7. Your Content and Responsibilities
As between you and Stratoxphere, you retain your rights in speech, text, screenshots, vocabulary, instructions, and other content you process with Dup (“User Content”). These Terms do not give Stratoxphere ownership of User Content.
You are responsible for User Content and for having all rights, permissions, and lawful bases required to capture, transcribe, disclose, modify, or otherwise process it. In particular, you must not use Dup to record people, meetings, communications, confidential material, personal data, or on-screen content where doing so would violate law, contract, workplace policy, or another person’s rights. You are responsible for providing any notice and obtaining any consent that applicable law requires.
8. AI Output
Transcriptions, rewrites, extracted vocabulary, and modifications may be inaccurate, incomplete, biased, offensive, or unsuitable for your purpose. Review output before relying on or sharing it. Dup is not designed for emergency, medical, legal, financial, employment, safety-critical, or other high-risk decisions, and output is not professional advice.
You are responsible for deciding whether and how to use output and for preserving source text before applying a modification where loss would matter.
9. Acceptable Use
You may not:
- use the Service unlawfully or to violate another person’s rights;
- evade account, commercial, promotional, activation, or licensing controls;
- share, resell, rent, sublicense, or commercially redistribute Dup or access to it;
- copy, modify, reverse engineer, decompile, disassemble, or attempt to derive Dup’s source code, except to the extent applicable law expressly permits and does not allow that restriction to be waived;
- interfere with, probe, overload, or bypass the security of the Service;
- use automation or false identities to obtain or manipulate accounts, purchases, offers, or entitlements;
- introduce malware or use Dup to facilitate harmful, deceptive, or infringing activity; or
- remove proprietary notices from Dup or its documentation.
10. Updates, Availability, and Changes to the Service
We may provide fixes, security updates, compatibility changes, or new versions. Dup depends on your operating system and third-party services. We do not guarantee that every feature will be continuously available or compatible with every device, application, environment, or third-party service.
We may modify or discontinue a feature or the Service. Where a change materially affects paid access, we will provide reasonable notice when practicable and honor any remedies required by applicable law. Security, abuse-prevention, legal, or emergency changes may take effect without advance notice.
11. Support
Support is provided on a reasonable-efforts basis through [email protected]. No service level, response time, or ongoing maintenance commitment applies unless we separately agree to one in writing.
Do not send a dictation history file or other User Content to support unless you have reviewed it and are authorized to disclose everything it contains.
12. Ownership
Dup, the Service, their design, software, documentation, trademarks, and other materials are owned by Stratoxphere or its licensors and are protected by applicable intellectual property laws. Third-party components remain subject to their respective licenses.
If you send feedback, you permit us to use it without restriction or compensation, provided that this does not give us ownership of User Content or personal data contained in the feedback.
13. Suspension and Termination
You may stop using Dup at any time. To request account deletion, email [email protected] from the email address associated with your Stratoxphere account. Removing Dup does not automatically resolve a pending payment dispute or erase records that we or Creem must retain by law.
We may suspend or terminate access if you materially breach these Terms, misuse the Service, create security or legal risk, engage in fraud, or if a purchase is refunded, reversed, or disputed. When reasonably possible, we will give notice and an opportunity to correct a remediable breach.
Upon termination, your license ends and you must stop using Dup. Provisions that by their nature should survive—including ownership and payment obligations—will survive.
14. Software Provided “As Is”
Nothing in these Terms excludes warranties, guarantees, or remedies that cannot lawfully be excluded.
To the maximum extent permitted by law, Dup and the Service are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or error-free operation. We do not warrant AI output, third-party services, or that Dup will preserve every item of data or work in every target application.
15. Changes to These Terms
We may update these Terms to reflect changes to Dup, third-party services, law, or our practices. The effective date identifies the applicable version. For a material change, we will provide reasonable advance notice through the Service, account interface, email, or release materials when required by law.
The Terms stored with a tagged Dup release document the terms presented for that release. Continued use after an updated version becomes effective constitutes acceptance only to the extent permitted by law. If you do not agree, stop using the Service.
16. General
These Terms, the Refund Policy, the Privacy Policy, and any terms expressly presented at checkout form the agreement between you and Stratoxphere concerning Dup. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, reorganization, or transfer of the Service, subject to applicable law.
